Ever since Binance’s former CEO Changpeng Zhao (CZ) got slammed with the largest corporate fine ever, $4.3 billion, and was forced to resign, everyone’s been asking the same question.
Is he going to jail?
Maybe not. Maybe, just like BitMex’s Arthur Heyes, CZ will probably get a slap on the wrist and maybe a few months (or possibly years) of home detention.
But, be that as it may, what we know for sure is CZ will not be able to leave the U.S. ahead of his February sentencing.
In the court filing, prosecutors pointed that Zhao holds Chinese, Canadian and UAE citizenships, and the latter is a problem.
According to the filing, CZ has “minimal ties to the U.S.” and as a resident and citizen of the UAE, he may not return to the US should he be allowed to leave because there’s no extradition treaty between the UAE and the U.S.
Prosecutors believe CZ is a flight risk. By contrast, magistrate Judge Brian Tsuchida reminded prosecutors that Zhao voluntarily came to the U.S. to surrender and plead guilty, so perhaps there’s flight risk at all.
Both parties have a point. But if I had to bet a dollar worth of BNB, I’d say he probably will not be allowed to leave.
